Acceptable Use & Call Recording Policy

Effective Date: May 29, 2026

This Acceptable Use and Call Recording Policy (the “AUP”) describes activities that are prohibited on the Prisma Voices platform (the “Service”) and your obligations when using the Service to make, receive, record, or transcribe telephone calls or send automated messages. The AUP is incorporated into our Terms of Service. A breach of this AUP is a material breach of the Terms. By using the Service, you agree to use it only for lawful business purposes and to take full responsibility for complying with the laws that apply to your calls, recordings, and messages.

1.

Who This Policy Applies To

This AUP applies to you, to anyone you authorise to use your account (employees, contractors, agents), and to anyone using the Service through credentials issued under your account. You are responsible for their conduct under the Service as if it were your own.

2.

Permitted Use in Summary

The Service is designed to help service businesses answer calls, schedule appointments, send confirmations and reminders, and capture leads. You may use the Service to:

  • Answer inbound calls from your customers, prospects, and the general public
  • Place outbound calls to recipients who have given you the level of prior consent required by law for the type of call you are making
  • Record and transcribe calls where you have provided any notice and obtained any consent required by federal and state law
  • Send SMS and WhatsApp messages to recipients who have given you the prior express consent required by law and applicable platform policies
  • Store, summarise, and search caller information for the purpose of operating your business

Anything not permitted by this AUP, or that violates the law of any jurisdiction in which your call recipients are located, is prohibited.

3.

Prohibited Conduct

You may not use the Service, and you may not allow anyone using your account to use the Service, to:

3.1 Violate the Law

  • Engage in any conduct that violates applicable federal, state, or local law, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the Truth in Caller ID Act, the federal Wiretap Act, state wiretap and call-recording statutes, consumer protection laws, fair lending and fair housing laws, the FTC Act, HIPAA (to the extent applicable to your business), and the laws of any foreign jurisdiction where your call recipients are located.
  • Place calls to numbers on the federal Do Not Call Registry or any state DNC registry, or to any individual or business that has revoked consent or asked to be placed on your internal Do Not Call list, except as permitted by an applicable exemption (e.g., established business relationship, prior express written consent for telemarketing, B2B calls where permitted).
  • Use a false, misleading, inaccurate, or 'spoofed' caller ID, or otherwise misrepresent the identity of the calling party.
  • Engage in robocalling or pre-recorded message campaigns to mobile or residential numbers without the prior express written consent required by the TCPA, or in any campaign that would constitute illegal robocalling.

3.2 Harm or Deceive Recipients

  • Impersonate any person, business, government agency, or other entity, or misrepresent your affiliation with any party.
  • Engage in fraud, phishing, 'vishing', pretexting, social engineering, identity theft, romance scams, investment scams, government-impersonation scams, fake debt collection, or any other deceptive scheme.
  • Harass, threaten, intimidate, defame, or invade the privacy of any person.
  • Use the Service to deliver unlawful debt collection, including failing to provide validation notices, calling consumers at prohibited times, or contacting third parties improperly under the Fair Debt Collection Practices Act.
  • Provide unlicensed medical, legal, financial, tax, immigration, or other regulated professional advice, or use the AI receptionist in a way that gives recipients the impression they are speaking with a licensed professional when they are not.

3.3 Promote Prohibited Content or Industries

You may not use the Service in connection with:

  • Adult content, sex work, escort services, or sexual services
  • Firearms, ammunition, explosives, or weapons sales
  • Illegal drugs, controlled substance fulfilment, or unlicensed pharmacies
  • Multi-level marketing schemes, pyramid schemes, or 'get rich quick' promotions
  • Unlicensed gambling, lotteries, or sweepstakes
  • Cryptocurrency promotions targeted at consumers, ICOs, or 'pump and dump' schemes
  • Predatory lending, payday lending where prohibited, or loan modification schemes
  • Hate speech, incitement of violence, or content that targets a protected class
  • Any business that has been the subject of an enforcement action by the FTC, FCC, CFPB, or a state attorney general for telemarketing, consumer protection, or call-recording violations, unless you have disclosed the matter to us and we have approved your use in writing

3.4 Abuse the Service or Infrastructure

  • Attempt to gain unauthorised access to the Service, our systems, our other customers' accounts, or any underlying infrastructure (Twilio, Vapi, WhatsApp, our cloud providers, or others).
  • Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security, authentication, or rate-limiting measures.
  • Reverse engineer, decompile, or attempt to extract the source code, model weights, prompts, or training data of the Service, except to the extent expressly permitted by applicable law.
  • Use the Service to transmit malware, ransomware, viruses, worms, or any other harmful code.
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of it, including by sending excessive traffic, repeated identical calls or messages, or workloads designed to consume disproportionate resources.
  • Resell, sublicense, or provide the Service to any third party, or use the Service to build, train, or improve a competing product.

3.5 Misuse AI Outputs

  • Hold out the AI receptionist as a human in jurisdictions or contexts where disclosure that the caller is interacting with an automated system is required by law (including, where applicable, California's 'Bot Disclosure' law).
  • Configure the AI receptionist to assert facts about prices, availability, qualifications, certifications, medical advice, legal advice, or guarantees that you know to be inaccurate, or that the AI cannot validate against a tool or data source.
  • Use the Service to generate, store, or transmit defamatory or harassing content about an identifiable person.
4.

Telemarketing and Consent

If you use the Service for any call or message that would be considered telemarketing, advertising, solicitation, or marketing under applicable law, you are responsible for:

  • Obtaining the level of consent required by law before the call or message. For autodialed or pre-recorded marketing calls and texts to mobile numbers in the United States, the TCPA generally requires prior express written consent. For some informational or transactional calls, prior express consent (not in writing) may be sufficient. For purely B2B calls, different rules may apply. You are responsible for knowing which rule applies to your call.
  • Maintaining records of consent sufficient to demonstrate compliance, including the source, method, date, and scope of consent.
  • Honouring opt-outs and DNC requests promptly, maintaining an internal Do Not Call list, and scrubbing your outbound lists against the federal and applicable state DNC registries.
  • Identifying yourself accurately, providing the disclosures required by the TSR and other applicable law (such as the purpose of the call and the seller's name), and offering a clear opt-out method.
  • Calling within permitted hours (generally 8 a.m. to 9 p.m. in the recipient's local time zone, plus stricter state-specific rules).

We may, from time to time, require you to provide evidence of compliance with this Section. Failure to provide reasonable evidence on request is a breach of the AUP.

5.

Call Recording & Transcription

The Service may record and transcribe calls. You are responsible for complying with all federal and state laws governing the recording and transcription of telephone calls.

5.1 Federal Baseline

Under federal law (the Wiretap Act, 18 U.S.C. § 2511), it is generally lawful to record a call if at least one party to the call has consented. Many states follow this “one-party consent” rule.

5.2 All-Party Consent States

A number of states require the consent of all parties to a call before it may lawfully be recorded. As of the effective date of this AUP, these states include:

  • California
  • Connecticut
  • Delaware
  • Florida
  • Illinois
  • Maryland
  • Massachusetts
  • Montana
  • Nevada (per state supreme court interpretation)
  • New Hampshire
  • Oregon (with state-specific nuances)
  • Pennsylvania
  • Washington

State law changes — you are responsible for keeping current with the law of every state in which your call recipients are located. When a call involves parties in different states, the stricter rule generally applies.

5.3 Required Disclosure

If you record or transcribe calls through the Service, you must, at a minimum:

  • Provide a clear and conspicuous notice at the beginning of every call that the call is being recorded, before any substantive conversation takes place; or
  • Obtain documented prior consent from the caller through another lawful means (for example, in a written agreement or via an IVR consent prompt).

The following sample greeting, played or spoken at the start of the call, is a starting point — you are responsible for confirming it is sufficient for your use case and the laws applicable to your callers:

“Hi, you've reached [Business Name]. Please note this call is being recorded for quality, training, and scheduling purposes. If you do not want the call recorded, please let us know and we'll be happy to take your information another way.”

For outbound calls, the disclosure must be made before recording begins. For inbound calls, the disclosure should be the first message the caller hears.

5.4 Healthcare, Financial Services, and Other Regulated Industries

If you operate in a regulated industry, additional rules may apply to what you record, store, and disclose — including HIPAA for protected health information, GLBA for non-public personal financial information, and various state laws governing biometric, genetic, and other sensitive data. The Service is not offered as a HIPAA-compliant service unless we have signed a Business Associate Agreement with you in writing.

5.5 International Calls

If you call recipients located outside the United States, additional or different recording and notice obligations may apply, including under the GDPR (EU/EEA/UK), PIPEDA (Canada), the Australian Privacy Act, and various national wiretap laws. You are responsible for compliance.

6.

Messaging (SMS & WhatsApp)

If you use the Service to send SMS or WhatsApp messages, you must comply with the TCPA, the CTIA Messaging Principles and Best Practices, the carrier rules implemented through your messaging provider (including 10DLC registration requirements where applicable), and the WhatsApp Business Messaging Policy. In particular, you must obtain prior express consent before sending marketing messages, include the required identification and opt-out disclosures in your messages, and process opt-outs immediately.

7.

Reporting Abuse and Trust & Safety

If you believe the Service is being used in violation of this AUP — for example, you received a call or message from a Prisma Voices number that appears to be a scam, harassment, or otherwise unlawful — please report it to abuse@prismavoices.com with as much detail as you can provide (the number you received the call or message from, the date and time, and a description of the conduct).

We investigate every report we receive. We may share information about the reported conduct with the customer responsible, with our telephony and messaging providers, and with law enforcement when required by law or appropriate to address the harm.

8.

Enforcement

We may take any of the following actions if we determine, in our reasonable discretion, that you have breached this AUP or that your conduct poses a security, legal, or reputational risk to us, our other customers, our providers, or the public:

  • Warning — we notify you of the issue and give you a defined period to come into compliance.
  • Restriction — we limit specific functionality (for example, outbound calling, recording, or messaging) while we investigate.
  • Suspension — we suspend your account in whole or in part, with or without notice, while we investigate or until you cure the breach.
  • Termination — we terminate your account and the Terms in accordance with Section 12 of the Terms of Service.

We may skip steps where the severity of the conduct, a legal obligation, or instructions from a telephony or messaging provider so requires. Fees paid prior to suspension or termination are non-refundable as described in our Refund & Cancellation Policy, and accrued usage fees remain due.

9.

Cooperation with Investigations

If a law enforcement agency, regulator, or carrier opens an investigation related to your use of the Service, you agree to cooperate with us in good faith, provide information we reasonably request, and indemnify us in accordance with Section 15 of the Terms of Service. We may, where required by law or appropriate to address the conduct, preserve and disclose information about your use of the Service to the relevant authority.

10.

Reservation of Rights

We may amend this AUP from time to time as the law, the practices of our providers, or our enforcement experience evolves. Material changes take effect no earlier than fourteen (14) days after notice to active customers, except where a faster effective date is required by law or by a provider. Your continued use of the Service after the effective date constitutes acceptance.

Nothing in this AUP limits any other right or remedy available to us under the Terms of Service or applicable law.
